User Service Agreement

This Agreement outlines the terms and conditions for using SmartWagerHub's services. It defines your rights, responsibilities, and our obligations as a licensed provider of online wagering in Australia.

1. Agreement Overview & Acceptance

This User Service Agreement (“Agreement”) governs your access to and use of the SmartWagerHub website, services, mobile applications, and any associated content or features (collectively referred to as the “Platform”), provided by SmartWagerHub Pty Ltd (“SmartWagerHub”, “we”, “our”, or “us”).

By accessing, registering for, or using any part of the Platform, you acknowledge that you have read, understood, and agreed to be legally bound by this Agreement, including our Privacy Policy, Cookie Policy, and Operational Rules & Guidelines.

If you do not agree with any part of these terms, you must immediately discontinue use of the Platform.

This Agreement is applicable only to individuals who are at least 18 years of age and who are legally permitted to participate in wagering activities in their jurisdiction. You represent and warrant that you meet these requirements.

We reserve the right to modify this Agreement at any time. Material changes will be communicated via appropriate channels and reflected by the "Last updated" date displayed above. Your continued use of the Platform signifies your acceptance of any changes.

2. Account Registration & Verification

In order to access certain features of the SmartWagerHub Platform, you must create a registered user account. You agree to provide accurate, complete, and current information at the time of registration and to maintain and promptly update your account information to ensure its accuracy.

2.1 Identity Verification

As required by applicable Australian law, including anti-money laundering (AML) and wagering regulations, you may be asked to verify your identity, age, and residential address. This may involve submitting personal documents such as a driver’s licence, passport, or utility bill.

We reserve the right to suspend, limit, or close any account where verification cannot be completed to our satisfaction within the legally required timeframe.

2.2 Security & Responsibility

You are solely responsible for safeguarding your account credentials and for any activity conducted through your account. You agree to notify us immediately at [email protected] if you suspect unauthorised use or security breaches.

2.3 One Account Policy

Each individual is permitted to register only one SmartWagerHub account. Duplicate accounts may be suspended or closed, and associated wagers or bonuses may be voided.

3. Deposits, Withdrawals & Account Funds

3.1 Deposits

You may fund your SmartWagerHub account using the payment methods made available within your account dashboard. All deposits must originate from a payment method legally held in your name. Third-party deposits are strictly prohibited and may be reversed or restricted at our discretion.

Funds deposited are available exclusively for the purpose of placing wagers and may not be used for any unlawful activity.

3.2 Withdrawals

You may request a withdrawal of your available balance at any time, subject to identity verification requirements, review of wagering activity, and any applicable account restrictions or verification pending.

Withdrawal requests will be processed using the original deposit method where possible or via another compliant method at our discretion. We reserve the right to impose minimum or maximum withdrawal limits and to charge reasonable fees for processing or administration, where disclosed.

3.3 Account Balances

You are responsible for regularly reviewing your transaction history and account balance. In the event of an error or discrepancy, you must contact us within 14 days to request an investigation. We reserve the right to correct balance errors at any time, including reversing incorrectly credited funds.

3.4 Inactive Accounts

If your account remains inactive (i.e., no login or wagering activity) for a continuous period of 12 months, we may classify it as dormant. In accordance with applicable law, we may charge a reasonable monthly inactivity fee or close the account after prior notification. Funds remaining in dormant accounts may be remitted to a regulatory authority as unclaimed money in compliance with state regulations.

4. Responsible Use of the Platform

4.1 Personal Use Only

The SmartWagerHub Platform is intended for personal, recreational use only. You may not use the Platform for commercial purposes, syndicate wagering, or in connection with any activity that is fraudulent, abusive, or otherwise in violation of applicable laws or this Agreement.

4.2 Fair Play

Users are expected to engage fairly and respectfully. Any attempts to exploit technical vulnerabilities, use automated tools (e.g., bots, scripts), or manipulate markets or odds will result in immediate account suspension and may be reported to the relevant authorities.

4.3 Geographic Restrictions

Access to the Platform is restricted to individuals located in jurisdictions where online wagering is lawful. You agree not to access or use the Platform if you are located in a region where such activity is restricted or prohibited.

4.4 Account Misuse

You agree not to impersonate any person or entity, misrepresent your affiliation with SmartWagerHub, or engage in any action that could disrupt the experience of other users or damage the integrity of the Platform. Suspicious activity may be monitored and investigated in cooperation with regulatory bodies.

5. Responsible Gambling & Self-Exclusion

5.1 Our Commitment

SmartWagerHub is committed to supporting responsible gambling practices. We strive to ensure that wagering remains a form of entertainment and does not lead to financial or personal harm.

We provide users with access to tools, resources, and support that promote healthy betting habits and help reduce the risk of gambling-related harm.

5.2 Self-Exclusion

You may request a temporary or permanent self-exclusion from your account at any time. During the self-exclusion period, access to the Platform will be disabled, and any attempts to reopen your account may be denied based on our responsible gambling policy.

6. Intellectual Property & Content Rights

6.1 Ownership

All content, branding, graphics, logos, audio, video, data, software, and documentation made available through the SmartWagerHub Platform (collectively, “Content”) is owned by or licensed to SmartWagerHub Pty Ltd and is protected by applicable Australian and international intellectual property laws.

6.2 Limited Licence

We grant you a limited, non-transferable, non-exclusive licence to access and use the Platform and its Content for personal, non-commercial purposes, subject to this Agreement. You may not reproduce, modify, republish, distribute, display, reverse engineer, or create derivative works from any part of the Platform or Content without our prior written consent.

6.3 User-Generated Content

If you submit, upload, or post any content to SmartWagerHub, including reviews, feedback, or suggestions, you grant us a royalty-free, worldwide, perpetual, and irrevocable licence to use, reproduce, adapt, and publish such content for any purpose, without compensation or acknowledgment.

6.4 Third-Party Content

The Platform may include content, services, or links provided by third parties. We do not endorse or control such content and disclaim all liability associated with third-party websites, data, or services. Use of third-party platforms is subject to their respective terms.

7. Privacy & Data Protection

7.1 Our Commitment to Privacy

SmartWagerHub is committed to protecting your personal information in accordance with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Your use of the Platform is also governed by our Privacy Policy.

7.2 Information We Collect

We may collect personal information including your name, email address, contact details, age, identity verification documents, IP address, device type, and transaction history in order to provide and improve our services and to comply with regulatory requirements.

7.3 Use of Your Information

Your personal data is used for account management, customer support, fraud prevention, legal compliance, and tailored user experience. We may use aggregated, non-identifiable data for analytics and performance monitoring.

7.4 Data Security

We implement technical and organisational safeguards to protect your information from loss, misuse, and unauthorised access. However, no internet-based service can be completely secure. We encourage you to take steps to protect your own data, including secure passwords and two-factor authentication where available.

7.5 Sharing of Data

We may share your personal information with third-party service providers, regulatory authorities, or law enforcement, where required by law or necessary for platform operations. We do not sell your data to third parties for commercial gain.

7.6 Access & Control

8. Termination, Suspension & Dispute Resolution

8.1 Account Suspension or Termination

We reserve the right to suspend or terminate your account without prior notice if we have reason to believe that you have breached these Terms of Service, engaged in unlawful or unethical behaviour, or used the Platform in a manner that risks the integrity or security of our services or users.

Suspensions may be temporary or permanent depending on the nature and severity of the breach. We may withhold withdrawals and conduct investigations where required by law or regulation.

8.2 Voluntary Account Closure

You may request to close your account at any time by contacting [email protected]. Please note that we may retain certain information as required by law or for fraud prevention, even after closure.

8.3 Dispute Handling

If you have a complaint or dispute relating to our services, please first contact our support team. We will make every reasonable effort to resolve your concern internally, fairly, and promptly.

If the matter cannot be resolved internally, you may escalate your complaint to the New South Wales Independent Liquor & Gaming Authority or another recognised body, depending on jurisdiction.

8.4 Governing Law & Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. By using this Platform, you agree to submit to the exclusive jurisdiction of the courts of New South Wales in relation to any legal matters arising from this Agreement.

9. Liability, Indemnity & Disclaimers

9.1 Platform Use at Your Own Risk

The SmartWagerHub Platform is provided on an “as is” and “as available” basis. We do not guarantee that the Platform will be error-free, uninterrupted, or secure at all times. While we make every effort to maintain uptime, performance, and data accuracy, we make no warranties of any kind, express or implied, to the fullest extent permitted by law.

9.2 Limitation of Liability

To the maximum extent permitted by applicable law, SmartWagerHub Pty Ltd and its affiliates, directors, employees, or agents shall not be liable for any direct, indirect, incidental, special, or consequential losses, damages, or expenses arising from your use of (or inability to use) the Platform or its services — including, but not limited to, wagering decisions, system errors, unauthorised access, or delays.

9.3 Indemnity

You agree to indemnify, defend, and hold harmless SmartWagerHub Pty Ltd from and against any claims, liabilities, losses, damages, expenses, or legal fees arising out of or related to your use of the Platform, your breach of these Terms, or your violation of any laws or third-party rights.

9.4 External Services

Where links, widgets, or APIs connect you to third-party services, you acknowledge that these are provided for convenience only and that SmartWagerHub is not responsible for the functionality, content, or security of such external services.

10. General Terms & Final Provisions

10.1 Amendments to These Terms

We may update or amend this User Service Agreement from time to time to reflect changes in law, regulatory guidance, or platform functionality. You are responsible for reviewing the most current version available at smartwagerhub.com/user-service-agreement.php. Continued use of the Platform after changes take effect constitutes your acceptance of the revised terms.

10.2 Entire Agreement

This Agreement, along with our Privacy Policy, Cookie Policy, and Rules & Regulations, represents the entire agreement between you and SmartWagerHub Pty Ltd regarding your use of the Platform. It supersedes any prior understandings or agreements, whether oral or written.

10.3 Severability

If any provision of this Agreement is found to be invalid or unenforceable under applicable law, such provision shall be removed or modified to the minimum extent necessary, and the remainder of the Agreement shall remain in full force and effect.

10.4 Waivers & Assignment

Our failure to enforce any provision of this Agreement shall not be considered a waiver of our rights. You may not assign or transfer your rights under this Agreement without our prior written consent.
